Company or LLP Registration

In India, many businesses begin as proprietorships or partnerships without formal registration from the Central Government. The registration of companies and LLPs in India falls under the regulation of the Ministry of Corporate Affairs. If your business is likely to cross Rs. 20 lakh in yearly revenue, opting for LLP or Company registration is a smart move. Once a company or LLP is registered, it becomes a distinct legal entity, offering promoters limited liability protection. Moreover, registration allows smooth ownership transfer and enjoys perpetual existence as a registered entity. GST Registration

Depending on the nature and size of the food business, FSSAI issues three types of licenses or registrations:  

  • FSSAI Central License
  • FSSAI State License

Shop and Establishment Act License

The Shop and Establishments Act was introduced to regulate business operations, including working hours, wages, employee safety, and child labor laws. Shop and Establishment license or registration is issued by the State Governments, and it varies from state to state. Therefore, depending on where your business is situated, the concerned state government authority will give you a Shop and Establishment Act License.  

Gumastha licence

A Gumanstha License is for those who are planning to start their business in the state of Maharashtra. To obtain this, one must have the following documents: 

  • PAN Card
  • A valid address proof or an NOC (No Objection Certificate) from the landlord is required.
  • An application letter in the prescribed format to the Municipal Corporation of Greater Mumbai
  • Authority Letter for Business
  • Government Prescribed Fees for a Partnership Firm
  • Memorandum and Article of Association
  • Certificate of incorporation of the Company
  • Director’s ID and proof of address

Requirements to Qualify for a Business License in India

The process of applying for a business license in India differs based on the type of business and the specific approvals necessary.

  • Age: The age of the applicant must be 18 years or above.
  • Legal status: Your business must be legally recognised.
  • Citizenship or residency: Only an Indian citizen or foreign national with a valid visa is eligible to apply for a business license in India.
  • Educational Qualification: There are some business licenses that require a specific educational qualification. 
  • Experience: To qualify for certain business licenses, applicants must have a background in the relevant sector.
  • Financial stability: Certain business licenses require applicants to prove their financial stability.
